Terms & Conditions:

1. The above prices are inclusive of all Taxes & Duties.

2. Further M/s Data Spec, Vardhman and Phutela has offered their price for supply at Chandigarh. However they will supply the required items at FOR destination in the state of HARYANA.

3. Inspection of the material up to the order value of Rs.25,000/- may be carried out if desired at the works of the supplier and inspection of material more-than the order value of Rs.25,000/-, may be carried out at consignee site or at the premises/works of the supplier.

4. The supplier will provide warranty on the material against any manufacturing defect for a period of three months. Manufacturing defect means the item does not work or malfunctioning at the time of its initial use. The supplier should ensure that the date of the expiry of the product should not be less than six months from the date of supply.

5. Payment Terms: 100% against delivery and inspection (if desired/necessary) but not later than 2 weeks from the date of delivery. In case, any department/organization does not release payment of the supplier within 4 weeks from the date of supply & submission of bill, then interest @ 2% per month may be claimed by the supplier.

6. Delivery period: Ex-stock but not later than 2 weeks from the date of receipt of order by the supplier.

7. Penalty Clause: After expiry of delivery period, 2% penalty per week will be applicable. In case of genuine reason for late delivery, then the same can be exempted as per the norms mentioned in the tender document.

8. In case, any free gift scheme/ cash scheme is launched by Principal or firm, same will be provided by the rate contracted vendor free of cost to the purchasing department and it will be treated as a part of the agreement.

9. The incentive or cash scheme will be availed by the purchasing department at the time of purchase directly from the firm during validity of the scheme. The claim of the scheme will be considered with respect to the date of billing of the item(s).The cash scheme list will be provided by the Rate Contracted vendors on monthly basis and the same will be passed on to purchasing department. For counter checking of this, purchasing department will check the cash scheme for the Toner Cartridges, Inkjet Cartridges from Rate Contracted vendors. In case of discrepancy, same can be verified from HARTRON. For double counter checking, the purchasing department will sent a copy of purchase order and bill to HARTRON.

10. In case there is downward revision of prices in the price list of any product by the Principal during the Rate Contract, same will be applicable for this Rate Contract. However, in case there is increase in price for any items during the Rate Contract period of one year, same will be absorbed by the firm.

11. Validity of Rate Contract:- Upto 1 Year from the date of sign of agreement. However, it has been observed that Ink/Toner Cartridges etc. gets upgraded and some products are dropped by the Principal during the Rate Contract period. In such cases vendors may not be able to supply such approved items. Intimation in this regard will be issued from time to time.

12. Order will be placed on Rate Contracted vendor(s) by the purchasing Department / Organizations and payment will also be released directly. However, copy of purchase order is to be endorsed to MD, HARTRON for reference purpose.

13. This Rate Contract is valid for Govt. Departments/Organizations of Haryana State only.

14. All the Terms & Conditions of tender document for Rate Contract for Computer media and consumables will also be applicable.

15. In case R/C items of same make are available in less price then the R/C prices during that period from its authorized dealers/distributors on the similar terms & conditions, intimation of the same be given to HARTRON in written in the interest of the state Govt. to take further action.\

16. In case of any dispute the decision of The Commissioner & Secretary to Govt. of Haryana, Information Technology Department will be final and binding on all the parties.
